    United States Permanent Residece

    Family-Based ImmigrationFamily-based  immigration is the most common form of immigration to the United States. Choate & 4,1) United States Permanent ResideceSeletski leads our clients from the time we first interview them to the end of the immigration process, including collecting all necessary documents, preparing and filing various immigration petitions and applications, attending interviews, filing for removal of a condition on permanent residence, lost or stolen permanent resident cards, etc.

    A U.S. citizen can generally petition for

    • his or her foreign spouse
    • his or her foreign parents, but only if a U.S. citizen child is at least 21 years old
    • his or her foreign unmarried child or children (the U.S. immigration law defines “child” as a person under the age of 21)
    • his or her foreign adult unmarried sons and daughters (those who are over the age of 21)
    • his or her foreign married children (under the age of 21) and married adult sons and daughter (those who are over the age of 21)
    • his or her foreign siblings (brothers and sisters), but only if a U.S. citizen is at least 21 years old

    A U.S. permanent resident (a green-card holder) can only petition for

    • his or her foreign spouse
    • his or her children
    • his or her unmarried sons and daughters

    Fiancé(e) Visa. Only a U.S. citizen can petition to bring his or her foreign fiancé(e) to the United States (K-1 visa). There are several requirements both the U.S. citizen and his or her fiancé(e) has to meet such as, a fiancé(e) must be outside the United States, both the U.S. citizen and his or her foreign fiancé(e) has to meet at least once within two years of an application for a K-1 visa, and upon arrival to the United States, they have to marry within 90 days, etc. Please feel free to contact us for a consultation.

    Diversity Immigrant Visa Lottery (DV)
    .
    The Diversity Immigrant Visa program, also known as the green card lottery 1l(DV), is a United States congressionally mandated lottery program for receiving a United States Permanent Resident Card. The lottery makes available 55,000 permanent visas annually. Choate & Seletski assists our clients preparing and filing a lottery application and, if case when our client has won, we prepare and file all necessary documents in order to obtain a United States Permanent Resident Card (green card).

    United States Citizenship

    A person who has been a U.S. permanent resident (a  green-card holder) for 5 years or 3 years (if married to a4) United States Citizenship  U.S. citizen) is eligible to apply for United States citizenship. However, there are some other requirements a U.S. permanent resident has to meet in order to be able to file an application for U.S. citizenship and/or, if filed, to have his or her application be granted.

    We, at Choate & Seletski, thoroughly interview our clients, study their cases and assist our clients with the preparation of his or her citizenship application and citizenship test (language and United States history). One of our attorneys always accompanies our clients to their citizenship interview.
